ja meille ("Yritys", "me", "meitä" tai "meidän") koskien verkkokauppaan pääsyäsi ja tavaroiden ostamista.
Pidätämme oikeuden muuttaa tai päivittää näitä käyttöehtoja milloin tahansa. Tiettyyn tilaukseen sovelletaan ostohetkellä voimassa olevaa versiota käyttöehdoista.
2.Tavaroiden tilaus
2.1. Voit tehdä tilauksen lisäämällä valitut tuotteet ostoskoriin, antamalla tarvittavat tiedot ja suorittamalla maksuprosessin.
2.2. Pidätämme oikeuden hylätä tai peruuttaa minkä tahansa tilauksen oman harkintamme mukaan, mukaan lukien perustuen petosepäilyihin, virheelliseen hinnoitteluun tai tavaroiden saatavuuden puutteeseen.
2.3. Asiakas vastaa siitä, että kaikki tilauksen yhteydessä annetut tiedot, mukaan lukien nimi, toimitusosoite, sähköpostiosoite ja puhelinnumero, ovat oikeita ja ajantasaisia. Toimituksen onnistumiseksi voidaan edellyttää puhelinnumeron antamista.
3.Maksu ja hinta
3.1. Verkkokaupassa esitettyjen tavaroiden hinnat ovat euromääräisiä ja sisältävät kaikki sovellettavat verot, ellei toisin mainita.
3.2. Pidätämme oikeuden muuttaa hintoja milloin tahansa, mutta tilaukseen sovellettava hinta on ostohetkellä ilmoitettu hinta.
3.3. Maksut käsittelee Paytrail Oyj ("Paytrail"). Paytrail tarjoaa useita maksutapoja, joista sinun on valittava yksi maksaaksesi.
1.1. Sitoudut antamaan ajantasaiset, täydelliset ja tarkat maksu- ja tilitiedot kaikkiin Palveluiden kautta tehtyihin ostoihin. Lisäksi sitoudut tarjoamaan tili- ja maksutiedot, kuten sähköpostiosoite, maksutapa ja maksukortin viimeinen voimassaolopäivä, jotta Paytrail voi suorittaa maksutapahtumat ja ottaa sinuun tarvittaessa yhteyttä.
4.Toimitus
4.1. Pyrimme toimittamaan tavarat kohtuullisesti sovitussa aikataulussa. Toimitusajat ovat kuitenkin arvioita, ja niihin voi liittyä viivästyksiä, joihin emme voi vaikuttaa. Osa tuotteista valmistetaan tilauksesta tai käsityönä asiakkaan tilauksen jälkeen. Tämän vuoksi toimitusaika voi vaihdella tuotteesta riippuen. Arvioitu toimitusaika ilmoitetaan tuotetiedoissa tai tilausvahvistuksessa.
4.2. Toimitamme tavarat siihen osoitteeseen, jonka annoit tilausprosessin aikana.
4.3. Tavaroiden omistusoikeus ja vaara tavaroiden katoamisesta tai vahingoittumisesta siirtyy sinulle toimituksen yhteydessä.
4.4. Vastaat kaikista lisäkustannuksista, jotka aiheutuvat toimitusohjeiden muuttumisesta tai toimituksen hyväksymättä jättämisestä.
4.5. Sinun on hyväksyttävä tavarat toimituksen yhteydessä sovittujen ehtojen mukaisesti. Hyväksyminen merkitsee, että tavarat vastaavat sovittuja eritelmiä ja ovat virheettömiä.
4.6. Pidätämme oikeuden lähettää pienet lähetykset kirjeenä kotiin.
4.7. Pidätämme oikeuden lähettää pakettiautomaatin maksimimittoja suuremmat lähetykset postiin.
4.8. Asiakas vastaa siitä, että lähetys noudetaan määräajassa noutopisteestä. Noutamatta jäänyt lähetys voidaan palauttaa lähettäjälle, jolloin asiakas vastaa mahdollisista uudelleenlähetyskuluista.
5.Palautus ja hyvitykset
5.1. Sinulla on oikeus palauttaa tavarat 14 päivän kuluessa toimituspäivästä sovellettavassa kuluttajansuojalainsäädännössä säädettyjen ehtojen ja rajoitusten mukaisesti. Palautusoikeus ei koske tuotteita, jotka on valmistettu asiakkaan toiveiden mukaisesti tai yksilöllisesti personoitu asiakkaalle. Tällaisia tuotteita voivat olla esimerkiksi nimikoidut tuotteet, logotuotteet sekä muut mittatilaustyöt.
5.2. Tavaroiden on oltava alkuperäisessä kunnossa, avaamattomia ja käyttämättömiä, pois lukien tilanteet joissa tavarat ovat viallisia tai vahingoittuneet toimituksen yhteydessä. Korvakorujen osalta palautusoikeus koskee hygieniasyistä vain käyttämättömiä tuotteita.
5.3. Palautamme ostohinnan kohtuullisen ajan kuluessa palautettujen tavaroiden vastaanottamisesta, vähennettynä mahdollisilla uudelleenvarastointimaksuilla ja -kuluilla. Tätä palautusta varten käytämme samaa maksuvälinettä, jota käytit alkuperäisessä kaupassa, ellei kanssasi ole nimenomaisesti toisin sovittu.
5.4. Sinun on maksettava tavaran arvon alenemisesta vain, jos arvon aleneminen johtuu tavaran käsittelystä, joka ei ole välttämätöntä tavaran kunnon, ominaisuuksien ja toiminnan testaamiseksi.
6.Takuu
6.1. Pyrimme kaikin tavoin esittämään verkkokaupassamme saatavilla olevien tuotteiden värit, ominaisuudet, tekniset tiedot ja yksityiskohdat mahdollisimman tarkasti. Emme kuitenkaan takaa, että tavaroiden värit, ominaisuudet, tekniset tiedot ja yksityiskohdat ovat tarkkoja, täydellisiä, luotettavia, ajantasaisia tai virheettömiä, ja sähköinen näyttösi ei välttämättä anna tarkkaa kuvaa tavaroiden todellisista väreistä ja yksityiskohdista. Kaikki tavarat toimitetaan saatavuuden mukaan, emmekä voi taata, että tuotteita on varastossa. Pidätämme oikeuden lopettaa minkä tahansa tavaran toimittamisen milloin tahansa mistä tahansa syystä. Lisäksi tuotteet valmistetaan osittain käsityönä ja luonnonmateriaaleista. Puunsyykuviot, sävyt, narupintojen tekstuurit sekä muut luonnolliset yksityiskohdat voivat vaihdella tuotteesta toiseen. Nämä vaihtelut ovat osa tuotteen luonnetta eivätkä ole valmistusvirheitä.
6.2. Takaamme, että tavaroissa ei ole materiaali- tai valmistusvirheitä.
6.3. Sinun on tarkastettava tavarat viipymättä toimituksen jälkeen ja ilmoitettava meille kirjallisesti mahdollisista vioista tai vaatimustenvastaisuuksista kohtuullisen ajan kuluessa.
6.4. Jos takuuvaatimus on pätevä, voimme oman harkintamme mukaan korjata tai korvata vialliset tavarat tai palauttaa ostohinnan.
6.5. Takuu ei kata vikoja tai vaurioita, jotka johtuvat väärästä käytöstä, huolimattomuudesta tai normaalista kulumisesta. Takuu ei kata myöskään luonnonmateriaalien normaalia ikääntymistä, värisävyjen vaihtelua tai muita materiaalien luontaisia ominaisuuksia.
6.6. Lampunvarjostimet toimitetaan ilman lampunpidintä, johtoa ja valonlähdettä, ellei tuotetiedoissa toisin ilmoiteta. Lampunvarjostimien kanssa tulee käyttää ainoastaan LED-valonlähteitä.
7.Vastuunrajoitukset
7.1. Vastuumme näistä ehdoista johtuvista tai niihin liittyvistä vaatimuksista, olipa kyse sitten sopimuksesta, vahingonkorvauksesta tai muusta, rajoittuu sinun tavaroista maksamaasi kokonaissummaan.
7.2. Emme ole vastuussa mistään epäsuorista, satunnaisista, välillisistä tai rangaistusluonteisista vahingoista, mukaan lukien mutta ei rajoittuen voitonmenetyksiin tai liiketoiminnan keskeytyksiin.
8.Immateriaalioikeudet
8.1. Pidätämme kaikki verkkokauppaan liittyvät immateriaalioikeudet, mukaan lukien tekijänoikeudet, tavaramerkit ja patentit, mutta niihin rajoittumatta.
8.2. Et saa jäljentää, muokata, levittää tai myydä verkkokaupan sisältöä tai materiaalia.

10.Sovellettava laki ja oikeuspaikka
10.1. Näihin yleisiin sopimusehtoihin sovelletaan Suomen lakia ja ne on laadittu Suomen lakien mukaisesti, ja Yhdistyneiden Kansakuntien kansainvälistä tavaran kauppaa koskevien sopimusten yleissopimus on nimenomaisesti suljettu pois. Jos asuinpaikkasi on EU:n alueella ja olet kuluttaja, sinulla on lisäksi asuinmaasi lainsäädännön pakottavien säännösten tarjoama suoja. Molemmat osapuolet sopivat alistuvansa Helsingin tuomioistuinten ei-yksinomaisen toimivallan piiriin, mikä tarkoittaa sitä, että voit nostaa kanteen kuluttajansuojaa koskevien oikeuksiesi puolustamiseksi näihin yleisiin sopimusehtoihin liittyen Suomessa tai asuinpaikkasi EU-maassa.
10.2. Näistä AVL:stä johtuvat tai niihin liittyvät riidat kuuluvat Helsingin tuomioistuinten yksinomaiseen toimivaltaan.
11.Riitojen ratkaiseminen
Euroopan komissio tarjoaa verkkovälitteisen riidanratkaisufoorumin, jota voit käyttää. Jos haluat saattaa tämän asian meidän tietoisuuteemme, ota yhteyttä meihin.
12.Sekalaiset
12.1. Nämä käyttöehdot muodostavat koko sopimuksen sinun ja meidän välillämme tavaroiden toimittamisen osalta, ja ne syrjäyttävät kaikki aiemmat sopimukset, sopimukset tai esitykset, olivatpa ne sitten suullisia tai kirjallisia.
12.2. Se, että emme käytä tai pane täytäntöön mitään näiden yleisten käyttöehtojen oikeutta tai määräystä, ei merkitse tällaisesta oikeudesta tai määräyksestä luopumista.
12.3. Nämä ehdot ovat voimassa lain sallimissa rajoissa.
12.4. Voimme milloin tahansa siirtää osan tai kaikki oikeuksistamme ja velvollisuuksistamme muille.
12.5. Jos jokin näiden yleisten sopimusehtojen määräys tai sen osa todetaan laittomaksi, mitättömäksi tai täytäntöönpanokelvottomaksi, kyseinen määräys tai sen osa katsotaan irrotettavaksi näistä ehdoista, eikä se vaikuta jäljelle jäävien määräysten pätevyyteen ja täytäntöönpanokelpoisuuteen.

Peruuttamisajan noudattamiseksi riittää, että lähetät ilmoituksen peruuttamisoikeuden käyttämisestä ennen peruuttamisajan päättymistä.
Jos peruutat tämän sopimuksen, palautamme sinulle kaikki sinulta saamamme maksut ilman aiheetonta viivytystä ja viimeistään neljäntoista (14) päivän kuluessa siitä päivästä, jona saimme ilmoituksen sopimuksen peruuttamisesta. Tässä palautuksessa käytämme samaa maksuvälinettä, jota käytit alkuperäisessä maksutapahtumassa, ellei kanssasi ole nimenomaisesti toisin sovittu; palautuksesta ei missään tapauksessa peritä sinulta maksua.
Voimme kieltäytyä maksamasta takaisinmaksua, kunnes olemme saaneet tavarat takaisin tai kunnes olet vahvistanut, että olet palauttanut tavarat, riippuen siitä, kumpi ajankohta on aikaisempi.
Sinun on palautettava tai luovutettava tavarat meille ilman aiheetonta viivytystä ja joka tapauksessa viimeistään neljäntoista (14) päivän kuluessa siitä päivästä, jona olet ilmoittanut meille sopimuksen peruuttamisesta. Määräaikaa noudatetaan, jos lähetät tavarat ennen neljäntoista (14) päivän määräajan päättymistä.
Sinun on vastattava tavaroiden palauttamisesta aiheutuvista välittömistä kustannuksista.
Sinun on maksettava tavaran arvon alenemisesta vain, jos arvon aleneminen johtuu tavaran käsittelyn aiheuttamasta arvon alenemisesta, joka ei ole välttämätöntä tavaran kunnon, ominaisuuksien ja toiminnan kannalta.
Palautettavan tuotteen tulee olla käyttämätön ja olennaisesti samassa kunnossa kuin vastaanotettaessa. Asiakas vastaa tuotteen asianmukaisesta pakkaamisesta palautuksen ajaksi.
Peruuttamisoikeus ei koske tuotteita, jotka on valmistettu asiakkaan toiveiden mukaisesti tai joita on yksilöllisesti muokattu asiakkaalle. Tällaisia tuotteita ovat esimerkiksi personoidut tuotteet, nimikoidut tuotteet sekä asiakkaan toiveiden mukaan valmistetut mittatilaustyöt.
Mikäli tuote on vaurioitunut kuljetuksen aikana tai siinä havaitaan valmistusvirhe, pyydämme ottamaan yhteyttä Nordic Essenceen mahdollisimman pian tuotteen vastaanottamisen jälkeen.
Nordic Essencen tuotteet valmistetaan osittain käsityönä ja luonnonmateriaaleista. Puunsyykuviot, sävyt, narupintojen tekstuurit sekä muut luonnolliset yksityiskohdat voivat vaihdella tuotteesta toiseen. Nämä vaihtelut ovat osa tuotteen luonnetta eivätkä ole valmistusvirheitä.

1.Scope
We operate an online store https://holvi.com/shop/nordicessence/ where you can browse and purchase goods (“goods”) and which refer to these General Terms and Conditions (“Terms and Conditions”, “GTC”).
By placing an order through the online store, you acknowledge that you have read, understood and agreed to these Terms and Conditions.

We reserve the right to modify or update these Terms and Conditions at any time. The version of the Terms and Conditions that applies to a specific order will be the version in palace at the time of purchase.
2.Order of Goods
2.1. You may place an order by adding selected goods to the online shopping cart, providing necessary information and completing the payment process.
2.2. We reserve the right to refuse or withdraw any order in our sole discretion, including but not limited to cases of suspected fraud, incorrect pricing or unavailability of goods.
2.3. The customer is responsible for ensuring that all information provided at the time of ordering, including name, delivery address, email address, and phone number, is accurate and up to date. A phone number may be required to ensure successful delivery.
3.Payment and Price
3.1. The prices of the goods displayed on the online store are in Euros and inclusive of any applicable taxes, unless stated otherwise.
3.2. We reserve the right to modify prices at any time, but the price applicable to an order will be the price displayed at the time of purchase.
3.3. Payments are processed by Paytrail Oyj (“Paytrail”). Paytrail offers several means of payment, from which you need to select one to make your payment.
3.4. You agree to provide current, complete and accurate purchase and account information for all purchases made. You further agree to promptly update account and payment information, including email address, payment method and payment card expiration date, so that Paytrail can complete your transactions and contact you as needed.
4.Delivery and Title
4.1. We will make reasonable efforts to deliver the goods within the agreed-upon timeframe. However, delivery times are estimates and may be subject to delays beyond our control. Some products are made to order or handcrafted after the customer has placed an order. Therefore, delivery times may vary depending on the product. The estimated delivery time is stated in the product information or order confirmation.
4.2. We will deliver the goods to the address provided by you during the ordering process.
4.3. Title and risk of loss or damage to the goods shall pass to you upon delivery.
4.4. You shall bear any additional costs incurred due to any change in delivery instructions or failure to accept delivery.
4.5. You shall accept the goods upon delivery in accordance with the agreed-upon Terms and Conditions. Acceptance implies that the goods confirm to the agreed specifications and are free from defects.
4.6. We reserve the right to send small shipments as letter mail to the customer’s address.
4.7. We reserve the right to deliver shipments that exceed the maximum size limits of parcel lockers to a post office or other designated pickup point.
4.8. The customer is responsible for collecting the shipment within the specified time frame from the pickup point. Uncollected shipments may be returned to the sender, in which case the customer is responsible for any reshipping costs.
5.Return and Refunds
5.1. You have the right to return goods within 14 days from the date of delivery, subject to the conditions and limitations set forth in the applicable consumer protection legislation. The right of withdrawal does not apply to products that have been manufactured according to the customer's specifications or clearly personalised for the customer. Such products may include, for example, engraved or named products, products bearing a company logo, and other custom-made items.
5.2. Returns of goods must be in their original condition, unopened and unused, unless the goods are defective or damaged upon delivery. For hygiene reasons, the right of return for earrings applies only to unused products.
5.3. We will refund the purchase price within a reasonable timeframe after receiving the returned goods, minus any applicable restocking fees and charges. For this refund, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you.
5.4. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the condition, properties and functioning of the goods.
6.Warranty
6.1. We make every effort to display as accurately as possible the colours, features, specifications, and details of the goods available on our online store. However, we do not guarantee that the colours, features, specifications and details of the goods will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the goods. All goods are subject to availability and we cannot guarantee that items will be in stock. We reserve the right to discontinue any goods at any time for any reason. In addition, products are partly handmade and made from natural materials. Variations in wood grain patterns, colour tones, rope textures, and other natural details may occur between individual products. These variations are part of the character of the product and are not considered defects.
6.2. We warrant that the goods will be free from defects in materials and workmanship.
6.3. You shall promptly inspect the goods upon delivery and notify us in writing of any defects or non-conformities within a reasonable time.
6.4. In the event of a valid warranty claim, we may, at our sole discretion, repair or replace the defective goods or refund the purchase price.
6.5. The warranty does not cover defects or damages caused by improper use, negligence or normal wear and tear. The warranty does not cover the natural ageing of materials, variations in colour tones, or other inherent characteristics of natural materials.
6.6. Lamp shades are supplied without a lamp holder, cord set, or light source unless otherwise stated in the product description. Only LED light sources should be used with the lamp shades.
7.Limitations of Liability
7.1. Our liability for any claims arising out of or in connection with these Terms and Conditions, whether in contract, tort or otherwise, shall be limited to the total amount paid by you for the goods.
7.2. We shall not be liable for any indirect, incidental, consequential or punitive damages, including but not limited to loss of profits or business interruptions.
8.Intellectual Property
8.1. We retain all intellectual property rights in the online store, including but not limited to copyrights, trademarks and patents.
8.2. You shall not reproduce, modify, distribute or sell any content or materials from the online store.
9.Privacy Policy
We care about data privacy and security. Please review our Privacy Policy https://holvi.com/shop/nordicessence/privacy_policy/ . By using the Products, you agree to be bound by our Privacy Policy, which is incorporated into these GTC.
10.Governing law and venue
10.1. These GTC are governed by and constructed in accordance with the laws of Finland, and the use of the United Nations Convention of Contracts for the International Sales of Goods is expressly excluded. If your habitual residence is in the EU, and you are a consumer, you additionally possess the protection provided to you by obligatory provisions of the law in your country to residence. Both parties agree to submit to the non-exclusive jurisdiction of the courts of Helsinki, which means that you may make a claim to defend your consumer protection rights in regards to these GTC in Finland, or in the EU country in which you reside.
10.2. Any disputes arising out of or in connection with these GTC shall be subject to the exclusive jurisdiction of the courts of Helsinki.

12.Miscellaneous
12.1. These Terms and Conditions constitute the entire agreement between you and us with respect to the supply of goods and supersedes all prior agreements, understandings or representations, whether oral or written.
12.2. Our failure to exercise or enforce any right or provision of these GTC shall not operate as a waiver of such right or provision.
12.3. These Terms and Conditions operate to the fullest extent permissible by law.
12.4. We may assign any or all of our rights and obligations to others at any time.
12.5. If any provision or part of a provision of these GTC is found to be unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms and Conditions and does not affect the validity and enforceability of any remaining provisions.

Consumers have a right of revocation according to the following provisions (unless otherwise stipulated in the applicable laws), whereby a consumer is any natural person who concludes a legal transaction for purposes which can predominantly be attributed neither to their commercial nor to their independent professional activity.
You have the right to withdraw this contract within fourteen (14) days without giving any reason.
The withdrawal period is fourteen (14) days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

by means of a clear declaration (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You may use the enclosed model withdrawal form for this purpose, which is, however, not mandatory.
To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the end of the withdrawal period.
If you withdraw this contract, we must return to you all payments that we have received from you, without undue delay and at the latest within fourteen (14) days from the day on which we received the notification of your withdrawal of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.
We may refuse repayment until we have received the goods back or until you have provided verification that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen (14) days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the period of fourteen (14) days.
You shall bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to a loss of value due to handling of the goods which is not necessary for the condition, properties and functioning of the goods.
The returned product must be unused and in substantially the same condition as when it was received. The customer is responsible for ensuring that the product is properly packaged for return shipment.
The right of withdrawal does not apply to products that have been manufactured according to the customer’s specifications or that have been clearly personalised. Such products include, for example, personalised items, engraved or named products, and custom-made items produced according to the customer’s specific requests.
If the product is damaged during transport or if a manufacturing defect is discovered, we kindly ask you to contact Nordic Essence as soon as possible after receiving the product.
Nordic Essence products are partly handmade and made from natural materials. Variations in wood grain, tones, rope textures, and other natural characteristics may occur between individual products. These variations are part of the product’s natural character and are not considered defects.
Regarding earrings, for hygiene reasons, the right of withdrawal applies only to unused products.
